> Can you insure an AI data licensing deal? No published policy turned up. What to ask before anyone calls a deal insured: insurer, insureds, limits, exclusions.

## The short answer

Not off the shelf, as far as I can find: no published policy, named insurer or limits. If anyone calls a deal insured, ask for the policy: the insurer, who is insured, the limits, the exclusions and proof it's bound. Until you've read it, treat the deal as uninsured.

"Insured" is a reassuring word in a data deal. It's also easy to say.

## Does anyone publish insurance for a data licensing deal?

Not that I found. On 10 October 2026 I read [micro1's data partnerships page](https://micro1.ai/data-partnerships) and three [Polyshares](/buyers/polyshares) pages: [Polyshares data licensing](https://polyshares.com/data-licensing), [Polyshares deal process](https://polyshares.com/answers/how-data-licensing-deals-work) and [Polyshares data handling](https://polyshares.com/data-handling). None of them mentions insurance for the company licensing its data.

I also found no insurer publishing a policy built for licensing company records to AI buyers. If someone mentions a pilot or a partner insurer, the questions below turn that into paperwork you can read.

## Will your existing policies cover a data licensing deal?

Don't assume so. [Fenwick's June 2026 review](https://www.fenwick.com/insights/publications/end-silent-ai-emerging-ai-exclusions-coverage-fragmentation-and-practical-implications) reports insurers adding AI exclusions to several kinds of business policy, and advises reading the insuring agreement, definitions, exclusions and endorsements together.

Which policy types are moving, and where liability lands, are in [our page on who carries a breach at the buyer](/answers/who-is-liable-if-the-data-buyer-is-hacked).

## What should you ask for?

Ask for each of these in writing:

1. **The insurer.** The company that carries the risk, by its legal name. A broker or a platform is not the insurer.
2. **The insureds.** Whose name is on the policy. Are you an insured, or only the buyer?
3. **The limits.** The most it pays per claim and in total, and the deductible or retention you'd carry first.
4. **The exclusions.** Ask directly whether the policy excludes claims from the licensing itself, failed de-identification, breach of confidentiality and intellectual property claims.
5. **Proof it's bound.** A policy number and effective dates, on the policy or a binder from the insurer. A quote or a proposal is not cover.

## Is a certificate of insurance enough?

No. A certificate summarizes a policy. The [Iowa Insurance Division's Bulletin 10-04](https://iid.iowa.gov/media/129/download) (13 July 2010) reminds insurers and agents that certificates "do not convey any contractual rights." It adds that the policy governs the cover and a certificate can't alter it.

So the policy, or a binder, is the document to read.

Figure: steps A named insurer -> You are an insured -> Bound, exclusions read. A deal counts as insured once you hold a bound policy that names you.

## When can you call a deal insured?

When you hold a bound policy that names you, with limits and exclusions you have read with your broker or lawyer. Until then, your protection is the contract: the [reps and warranties](/answers/what-reps-and-warranties-does-an-ai-data-buyer-ask-for) you give, the indemnity, and the caps on each side.
