## The short answer

Podcast guests AI licensing consent turns on your release's exact words. A typical release covers recording, editing, publishing and the guest's name, image and voice, but not licensing to AI buyers. Ask counsel whether yours reaches it. AIPodcast re-clears guests in writing and drops episodes without consent.

A company podcast's back catalog looks like one asset. Each episode is really a stack of permissions, one per voice.

## What does a typical guest release cover?

A podcast guest release is written permission to record a guest and use the recording. A [Content Allies guide](https://contentallies.com/learn/podcast-guest-release) lists audio and video recording, editing, publishing and distribution, promotional use, name, image and voice, social clips, and transcripts and captions.

The same guide says a release should exclude synthetic voice cloning or misleading AI-generated replicas without separate consent. Its list of covered uses does not include licensing to AI buyers.

## How does an AI podcast licensor handle guests?

[AIPodcast](https://www.aipodcast.io/solutions/podcast-audio-licensing) says it runs retroactive guest re-clearance for older episodes, so that every voice in a licensed recording has a signed release. It says new guests sign on arrival.

It also says it excludes any episode where a guest cannot be reached or declines, and that it keeps per-episode consent receipts and a guest clearance log. Show owners receive a revenue share on each licensed hour, paid quarterly, with no rates published (self-reported).

## Why does the guest's voice matter?

Tennessee's ELVIS Act expanded that state's right of publicity to cover a person's voice, including a simulation of it ([Manatt summary](https://manatt.com/insights/newsletters/client-alert/tennessees-elvis-act-expands-publicity-rights-for)).

I can tell you what the law says. I can't tell you how it applies to your catalog. Rules differ by state, and a lawyer can tell you which ones reach your guests.

## What should you check in each release?

Use this list when you read your own paperwork:

- Does it name AI, machine learning or training data anywhere?
- Does it allow licensing to third parties, and for what purposes?
- Does it limit the media or the time period?
- Who signed, and can you prove it?
- Does anyone on the episode lack a release, such as a co-host, a staff member or a caller?

I never judge a specific contract here. Any answer on a given release belongs to counsel.

## What if a guest cannot be reached?

AIPodcast's published answer is to leave the episode out. Ask any buyer or marketplace how it handles unclear episodes and who bears the risk.

The [rights check](/rights-check) and the [risk map](/risks) list the questions, and the [guide to licensing your business's content](/guides/license-your-business-content-to-ai) covers members and clients as well.

For community posts, see [licensing members' posts](/answers/can-i-license-my-members-posts-to-ai). For the video side, see [licensing videos to AI companies](/answers/sell-videos-to-ai-companies).

Talk to a privacy or commercial lawyer in your state before you sign. No outcome is promised.

Figure: steps Find every guest, get a release -> Log each answer -> Leave out episodes with no yes. AIPodcast says it re-clears guests in writing and drops any episode without a yes.
