# License engineering firm data to AI: the licensing rule

> Wondering how to sell engineering firm data to AI? A license meets NCEES rules that bar revealing client information without consent. Copyright applies too.

## The short answer

Before engineering firm data goes to AI, check the NCEES model rules. They bar licensees from revealing client information without consent. micro1's data partnership page lists software and engineering as an area. Copyright rules and export controls apply. Counsel reads the client contracts first.

This page reports what the texts and buyer pages say. It is not legal advice.

## Who lists engineering firms?

[micro1's page](https://www.micro1.ai/data-partnerships) lists "software and engineering" as one area (self-reported). [Mercor's data page](https://www.mercor.com/data/) does not name engineering among its eight sectors.

[Polyshares](/buyers/polyshares)' [intake](https://polyshares.com/intake) lists AutoCAD among its design and CAD tools, the nearest any buyer comes to naming drawings. [Mercor](/buyers/mercor)'s page names spec sheets under manufacturing. I found no buyer that names calculation workflows as a data type.

Mercor's research team measures a related gap. Its [Benchmark Map](https://www.mercor.com/research/labor-index/benchmark-map/) (Oct 2026) counts 19 of the 56 architecture and engineering occupations as covered by at least 5 prompts from its 29 AI benchmarks. A benchmark is a test, not a purchase, so the map names no buyer or price.

## What do the NCEES model rules say about client information?

The [Model Rules](https://ncees.org/wp-content/uploads/Model-Rules.pdf) are published by the National Council of Examiners for Engineering and Surveying for state boards to adopt. Section 240.15 covers rules of professional conduct. In its part on obligations of licensees to employers and clients:

- Item 4 says licensees shall not reveal facts, data or information obtained in a professional capacity without the prior consent of the client, employer or public body they serve, except as authorized or required by law or rules.
- Item 9 says licensees shall not use confidential information received in the course of assignments as a means of making personal profit without the consent of the party it came from.

The rules govern licensees. Whether a firm's data deal counts as a licensee's disclosure depends on the facts and on the state's adopted text, which I did not check state by state.

## Who owns an engineering firm's drawings?

Federal copyright law says copyright vests initially in the author ([17 U.S.C. 201(a)](https://www.law.cornell.edu/uscode/text/17/201)). In a work made for hire, the employer or the person it was prepared for is treated as the author, and a transfer of copyright ownership is not valid unless it is in writing and signed by the owner ([17 U.S.C. 204(a)](https://www.law.cornell.edu/uscode/text/17/204)).

Which of those applies to a given drawing set turns on the client agreement, which these texts do not show. The [architecture page](/answers/sell-architecture-firm-data-to-ai) covers the AIA owner-architect form, which deems the architect and its consultants the owners of their drawings, and the [construction page](/answers/sell-construction-company-data-to-ai) covers the contractor's side.

## Do export controls apply?

They can. The export rule that treats releasing source code or technology to a foreign person in the United States as an export is on my [source code page](/answers/can-i-sell-source-code-to-ai), and the same question applies to engineering files that hold controlled technology. I did not research export law further.

## What can an engineering firm gather first?

List the clients and public bodies whose information sits in your files, the agreements that cover it and the states where your engineers hold licenses. The [rights check](/rights-check) asks the contract and personal-data questions and lists what to settle with counsel.

Talk to a privacy or commercial lawyer in your state before you sign.

Figure: comparison of Two NCEES model-rule duties on client information: Revealing information (emphasized: Covers any disclosure, Needs prior consent), Personal profit (Needs source's consent). NCEES item 4 bars revealing client information without prior consent, and item 9 bars using it for personal profit without consent.
