License sales call recordings to AI: what to check

The short answer

Consent from each person on the call is the first question, and counsel answers it. Few buyer pages name recordings, and none I read publish a price. Gong offers three consent methods. A 2026 federal ruling let Wiretap Act claims against Otter.ai go forward.

Tools such as Gong record sales calls by design, which makes them a ready-made archive. Every call also raises a consent question for each person on it.

Who says it takes call recordings?

Troveo lists Zoom under chat and messaging, the closest any buyer page I read comes to naming recordings. micro1's data page names CRM data, support tickets and contract workflows, and Mercor names no recordings. I found no buyer that publishes a price for recordings.

What do call platforms let you set?

Gong's help page says an admin can set a consent profile with three methods: an email 10 minutes before the call, a consent page before joining, or an audio message on joining.

Microsoft Teams has an explicit consent setting, ExplicitRecordingConsent, that requires participants to agree to being recorded or transcribed (Microsoft Learn).

Those settings show what a tool can ask. Whether your calls used them, and when, is a fact to pull from your own admin history.

What did the Otter.ai court decide?

The court let Wiretap Act, California Penal Code 631 and Illinois biometric claims go forward against a vendor that trained on conversations. Those are allegations at the pleading stage, and the defendant was a vendor. Can I license call recordings to AI walks through the order, the voiceprint statute and Spirit Airlines' carve-out.

How do sales calls connect to your other data?

Calls link to CRM notes, so the same people show up twice. See licensing CRM data to AI and meeting transcripts. The rights check asks about personal data and customer contracts.
